Comparative fiqh

The works that set out a question with the positions of the four schools and the evidence of each, instead of giving a single opinion. Bidayat al-mujtahid wa nihayat al-muqtasid by Ibn Rushd, Al-Ishraf 'ala madhahib al-'ulama by Ibn al-Mundhir, and the works of khilaf with their comparative tables. A shelf for after a school manual.

Is this shelf suitable for a beginner?

No. Comparative works assume the vocabulary of the chapters and the conditions is in place: without it, four positions on one question blur together instead of clarifying each other. Work through a school manual first, then come back here.

How can I recognise a good comparative work?

It names the reason for the disagreement, not only the four answers. That reason is nearly always a principle of usul or the assessment of a hadith. Bidayat al-mujtahid does exactly that, and it is what separates it from a compilation of opinions.

Do all these works cover transactions?

No, and that is the trap of this shelf. Some compare only on worship, others go as far as sales, partnerships and inheritance. Tell us what you want and we will check the actual scope before you order.
